PREPAID PLUS TERMS AND CONDITIONS (included in your purchased Prepaid Plus Starter Kit)
IMPORTANT! BY PURCHASING THE PREPAID KIT, IT IS EXPRESSEDLY UNDERSTOOD THAT THIS SIM CARD WILL WORK ONLY WITH AN IDEN SIM-BASED PHONE THAT IS NOT SIM-LOCKED TO ANY OTHER NETWORK. ABSOLUTELY NO RETURN OR EXCHANGE AFTER THE SIM CARD HAS BEEN DETACHED FROM THE SIM CARD HOLDER.
The subscriber hereby agrees to the following terms and conditions, which shall be in effect from the date of first use of the iCONNECT Prepaid Plus Service:
1. iCONNECT Prepaid Plus Services may be used only if the subscriber has all of the following:
a. A valid iCONNECT Prepaid Plus SIM Card;
b. A valid (unlocked) IDEN mobile handset; and
c. An iCONNECT Prepaid Plus Call Card that provides airtime value into the prepaid account.
2. iCONNECT Prepaid Plus SIM Card is the Subscriber Identity Module card that contains electronically encrypted data that are unique from other SIM cards. Prepaid service by nature does not require nor establish registered ownership. As such, request to disconnect a prepaid plus account will not be honored. iCONNECT Prepaid Plus SIM Cards are not replaceable nor the remaining credits refundable by cash in cases of loss, theft, or damage due to subscriber's neglect or misuse.
3. iCONNECT Prepaid Plus Kit contains a Prepaid Plus SIM Card, Call cards and an Instructions Guide. The default PIN code of your iCONNECT Prepaid Plus SIM Card is 0000. PIN codes are security numbers that must be keyed into the SIM. You have a maximum of 3 attempts to successfully key in your PIN code after which your iCONNECT Prepaid Plus SIM Card will be blocked. Note that once the sim card is blocked, further attempts to key in pin codes will permanently disable your sim card.
4. iCONNECT Prepaid Plus Call Card is a card with a dollar denominated value printed on its face. The printed dollar value corresponds to the allowable airtime value, which is consumed by the subscriber each time iCONNECT Prepaid Plus Services are accessed based on predetermined rates. iCONNECT Prepaid Plus Call Cards can be used only with an iCONNECT Prepaid Plus SIM Card and cannot be used with any other SIM card. iCONNECT Prepaid Plus Call Cards are not replaceable nor the remaining credits refundable for cash in cases of loss, theft, or damage due to subscriber's neglect or misuse.
5. When a subscriber's airtime balance falls below $0.25, he/she will not be able to make/receive cellular calls (except 911 emergency calls) until such time that the subscriber successfully reloads an iCONNECT Prepaid Call Plus Card before permanent disconnection.
6. The iCONNECT Prepaid Plus subscriber shall be responsible for all calls, SMS, and Value Added Services made through the use of his/her iCONNECT Prepaid Plus SIM Card and that appropriate charges shall accordingly be deducted from his/her prepaid account. All calls, SMS, and Value Added Services are subject to iCONNECT's approved prepaid rates prevailing at the time the calls, SMS, and Value Added Services are made, plus applicable toll charges and taxes. No claims for rebates or refunds due to use by unauthorized persons shall be allowed nor entertained. iCONNECT reserves the right to change the rates without prior notice.
7. An inherently defective iCONNECT Prepaid Plus SIM Card may be replaced within seven (7) days from first use. An inherently defective iCONNECT Prepaid Plus Call Card (missing, incomplete, or unclear card number) may be replaced provided there has been no prior usage of the card. All required documents and any replacement shall be subject to the investigation and sole discretion of iCONNECT.
8. It is the subscriber's responsibility to secure and safekeep his/her cellular handset, SIM Card, Pin Code and Call Card. Subscriber acknowledges and agrees that iCONNECT has no obligation to provide call details or itemized billing for calls made through iCONNECT Prepaid Plus Service.
9. The iCONNECT Prepaid Plus subscriber shall not use the iCONNECT Prepaid Plus Service, handset, iCONNECT Prepaid Plus SIM Card or iCONNECT Prepaid Plus Call Card for any malicious, unlawful, fraudulent, illicit, or abusive purpose. iCONNECT reserves the right and shall have sole discretion to terminate service to any subscriber found to have engaged in any of the foregoing purposes.
10. Choice Phone LLC shall not be liable for any direct, indirect, consequential, or other damages or losses resulting from the use or failure of the iCONNECT Service, or for any loss, damage, theft, or misuse of the iCONNECT Prepaid Plus SIM Card, Call Card, or any handset used as part of the iCONNECT Prepaid Plus Service.
11. Except as otherwise provided herein, Choice Phone LLC does not expressly or impliedly warrant the condition or merchantability of the information or communication services provided through the iCONNECT Prepaid Plus Service for any particular use or purpose.
12. Choice Phone LLC reserves the right to amend these terms and conditions at any time, with or without prior notice These terms and conditions shall be construed in accordance with the laws of Guam. All suits involving the iCONNECT Prepaid Plus Service shall be filed with the proper courts of Guam.
